Occupational Safety Health and Working Conditions Code (OSHWCC) Law Manual Book by Taxmann

Edition : 2026

Occupational Safety, Health and Working Conditions Code Law Manual is Taxmann's authoritative single-volume working reference on India's occupational safety, health and working conditions statute as it now operates in practice. The 2026 Edition is built around the editorial position that the Occupational Safety, Health and Working Conditions Code 2020 must be read as a system: the statute together with the rules made under it, the prescribed forms, the enforcement and Article 239 notifications, the dedicated post-enforcement clarifications and the cross-Code compliance machinery that surrounds it. The Manual brings all of these into one volume and arranges them so the reader can move between them in the order their work actually requires—concordance lookup, section text, editorial restatement, supporting case law, applicable rule, prescribed form, jurisdictional notification, FAQ, compliance checklist—without leaving the book.

The Manual also incorporates the Occupational Safety, Health and Working Conditions (Central) Rules 2026 with all 186 rules across fourteen chapters, seven annexures setting out the equipment lists for First Aid Box, Ambulance Room, First Aid Station and Medical Facilities Room, and twenty-seven prescribed Forms (Forms I to XXVII); this Edition is the first to carry the Code with that full implementation machinery in place.

The Manual is built for the reader who works with the OSH&WC Code as operative law and needs the supporting apparatus alongside the statutory text:

• HR, Industrial Relations and Compliance Heads in factories, mines, plantations, ports, construction projects, motor transport undertakings, contract-labour establishments, audio-visual production houses, newspaper establishments and inter-State migrant-worker-deploying establishments who have to reconfigure their registration, licensing, contractor onboarding, safety committee, accident reporting and welfare protocols under the new regime
• In-House Counsel and Labour-Law Practitioners advising on the new contract-labour licensing threshold of 50, the Section 57 prohibition on contract labour in core activities, Designated Authority adjudications, third-party audit certifications under Section 37, prosecutions under Sections 94 to 114, composition applications under Section 114, and writ matters arising out of the transition from thirteen repealed enactments
• Occupational Health, Safety and Welfare Officers, factory managers, mine managers, plantation managers, dock-safety officers and construction-site safety officers running the daily statutory committee architecture under Section 22, the Section 11 dangerous-occurrence notification regime, the Section 12 disease notification regime, the Site Appraisal Committee process under Section 83 and the hazardous-process disclosure obligations under Sections 84 and 85
• Trade Union Office-Bearers and Worker Representatives navigating the new safety, health and working-conditions framework, including audio-visual workers (anchors, news readers, dancers, dubbing artists, stunt persons) newly brought within statutory coverage under Section 66 and inter-State migrant workers under Sections 59 to 65
• Inspectors-Cum-Facilitators, Chief Inspectors, mining inspectorate personnel, dock-safety inspectorate personnel, registering and licensing officers, and members of the National Occupational Safety and Health Advisory Board, State Boards, Site Appraisal Committees, Safety Committees and the National Board constituted under Section 86
• Chambers of Commerce, Employer Federations and ER Advisory Teams interpreting the redrawn factory threshold, the contract labour core-activity framework, the bank-mode wage disbursement obligation under Section 55, the new experience certificate under Section 56 and the cross-Code interactions with Wages, IR and Social Security
• Faculty, Researchers and Students of Labour Law across LL.B., LL.M., CS, the CA Industrial Law paper, MBA-HR and the AIBE Labour & Industrial Law module, who need the consolidated text along with comparative reference to the thirteen legacy Acts the Code replaces

The Present Publication is the 2026 Edition, updated till 8^th May 2026. It is authored/edited by Taxmann's Editorial Board with the following noteworthy features:

• [Four-Layer Per-Section Treatment] Each section in Division One opens with the statutory text and the Corresponding Provision flag tying it back to the legacy Acts, then carries a Section Notes block that restates the operative content in plain-language bulleted form for quick recall, a Comments block of editorial restatement keyed by section number (with a nutshell synopsis followed by sub-numbered notes on the points that practitioners will actually argue), and—where the section has been substantively litigated—a Relevant Case Laws block carrying the line of decisions that bears on its interpretation. The case-law treatment draws on jurisprudence developed under the Factories Act, the Mines Act, the Contract Labour Act, the BOCW Act, the Plantations Labour Act, the Inter-State Migrant Workmen Act and the related PF, ESI, Industrial Disputes Act and Employees' Compensation Act decisions on the underlying concepts of 'wages', 'worker', 'supervisory capacity', 'manufacturing process' and 'principal employer' that continue to inform interpretation of the corresponding sections of the new Code
• [Purpose-Built Concordance Tables] The preliminary part carries fourteen concordance tables: one forward concordance from the Code into the thirteen legacy Acts read together, and thirteen separate reverse concordance tables—one each for the Beedi and Cigar Workers Act, the BOCW Act, the Cine-Workers Act, the Contract Labour Act, the Dock Workers Act, the Factories Act, the Inter-State Migrant Workmen Act, the Mines Act, the Motor Transport Workers Act, the Plantations Labour Act, the Sales Promotion Employees Act, the Working Journalists Act 1955 and the Working Journalists (Wages) Act 1958. The tables sit before the statutory text rather than at the back of the volume, on the editorial grounds that the buyer transitioning from a long-established legacy practice will start there
• [Long-Form Comparative Study] Set as a free-text analytical chapter rather than as a table, the 168-page Comparative Study reads the Code definition-by-definition through Section 2(1) and provision-by-provision through Sections 3 to 141 against the thirteen legacy Acts and flags every substantive change—meant to be read in sequence for transitional understanding rather than dipped into as a lookup
• [Occupational Safety, Health and Working Conditions (Central) Rules 2026 in Full] The full text of the operative Central Rules notified on 8-5-2026 is reproduced with the prescribed statutory Forms, organised across its full chapter sequence of fourteen chapters running parallel to the chapter architecture of the Code
• [Seven Annexures and Twenty-Seven Forms] Annexures are reproduced in full alongside the Central Rules. The twenty-seven prescribed Forms (Forms I to XXVII) are also covered. Because an employer's registers, notices, returns and licence applications must be drawn against the operative Forms, the in-volume reproduction is what makes this Manual an end-to-end compliance document for the operative regime—the reader does not have to step outside the book to draft or file
• [Material for Purposive Interpretation] The Statement of Objects and Reasons and the Notes on Clauses for the originating Bill are reproduced as separate apparatus blocks, on the editorial reasoning that purposive interpretation arguments before Tribunals and High Courts often turn on these materials
• [In-Volume Appendix of Cross-Referenced Statutes] Where the Code refers to a provision of another Act—the Metro Railways (Operation and Maintenance) Act 2002, the Indian Medical Council Act 1956, the Companies Act 2013, the Indian Partnership Act 1932, the Apprentices Act 1961, the ESI Act 1948, the EPF Act 1952, the Child and Adolescent Labour (Prohibition and Regulation) Act 1986 and several others—the referenced provision is reproduced in an Appendix, so the reader does not have to leave the volume to locate it
• [Concept-Led Subject Index] The index is built around the way HR, IR and compliance professionals actually search—registration, licensing of contractors, core activity, designated authority, inter-State migrant worker, journey allowance, toll-free helpline, Safety Committee, Safety Officer, Site Appraisal Committee, third-party audit, hazardous process, dangerous occurrence, audio-visual worker agreement, experience certificate, Inspector-cum-Facilitator, composition of offences, Social Security Fund—rather than around the section list
• [Complete Notifications and Clarifications Module] Division Three reproduces the principal enforcement notification, together with the foundational Article 239 notifications—each reproduced in full
• [Cross-Code Frequently Asked Questions] A five-part FAQ module covers all four Labour Codes—FAQs on the Code on Wages, the Industrial Relations Code, the OSH&WC Code, the Code on Social Security, and a separate dedicated tabular 'FAQ on OSH&WC Code, 2020 (as on 13.03.2026)' set out in Sl. No./Query/Clarification format. The OSH&WC FAQs, in particular, address the most frequently asked operational questions on the raised factory threshold, the raised contract labour licensing threshold, working-hours flexibility, women in night shifts and dangerous operations, the inspector-cum-facilitator system, the new statutory framework for transgender workers, portability of inter-State migrant worker benefits and the treatment of fixed-term employment under the worker definition
• [Multi-Chapter Compliance Handbook for the Four Labour Codes] Division Three closes with a six-chapter compliance reference for employers in the Central Government sphere—About the Handbook, Reforms Introduced under Labour Codes, The Code on Wages 2019, The Industrial Relations Code 2020, The Occupational Safety Health and Working Conditions Code 2020 and The Code on Social Security 2020—each anchored to specific section references and rendered as bullet-form obligation maps so the practitioner can move from a topic to a compliance action quickly

The structure is the editorial backbone of the Manual, organised as one preliminary part and three numbered Divisions, each one corresponding to a distinct working purpose—transitional reading, statutory and interpretive reference, operative rule-making, and implementation and compliance.

• Preliminary Part | Transitional Anchor — The preliminary part anchors the transitional reading, carrying the fourteen concordance tables and the 168-page Comparative Study before the statutory text, so a reader coming in from legacy practice begins with the bridge between the old and the new
• Division One | The Code and its Interpretive Apparatus — Division One carries the Occupational Safety, Health and Working Conditions Code 2020 in full with its four-layer per-section apparatus—statutory text, Corresponding Provision flag, Section Notes, Comments and Relevant Case Laws—together with the supporting interpretive materials including the Subject Index, the Statement of Objects and Reasons, the Notes on Clauses and the Appendix of cross-referenced statutes
• Division Two | Operative Rule-Making — Division Two carries the operative rule-making: the Occupational Safety, Health and Working Conditions (Central) Rules 2026 with the seven annexures and the Schedule of twenty-seven statutory Forms
• Division Three | Notifications, FAQs and Compliance — Division Three carries the implementation and compliance apparatus: the Notifications and Clarifications module reproducing the principal enforcement notification and the Article 239 cluster, the cross-Code FAQs covering all four Labour Codes with a dedicated tabular OSH&WC FAQ as on 13-3-2026, and the Compliance Handbook for Employers under the Four Labour Codes in the Central Government sphere
